Ontario is the most populated province in Canada. Approximately 40 percent of Canadians live in Ontario. The province is home to Ottawa – Canada’s capital city, as well as Toronto – the country’s largest city and primary business and financial center. Ontario is the economic, social and political heartland of Canada. It is by far the most popular destination in Canada for new immigrants from around the world, making it the most multicultural province in the country.

The population in the province speaks 125 spoken languages, and hails from over 200 different countries. The easiest way to immigrate to Ontario is with a provincial nomination under the Ontario Immigrant Nominee Program (OINP).

Ontario Immigrant Nominee Program (OINP)

The Ontario INP is designed to give select foreign nationals who are interested in immigrating to Ontario the opportunity to apply for Canadian permanent residence through an expedited process. Formerly called the Opportunities Ontario Provincial Nominee Program (OOPNP), the program is designed for prospective immigrants who possess the specific skills and experience needed in the province.

The Ontario Immigrant Nominee Program (OINP) supports employers by facilitating the immigration of managerial, professional and skilled foreign workers and international students required to meet their human resources needs. 

The province of Ontario operates the OINP in partnership with the federal immigration department, Immigration, Refugees and Citizenship Canada (IRCC). Interested candidates must follow a two-stage process:

  1. Application for nomination to the provincial government
  2. Those nominated by the province may apply for permanent residence with the federal government. 

An application may be submitted under one of the following four categories:

Human Capital

The human capital category has two sub-categories:

  • International graduate streams
  • Express Entry streams

The streams is suitable for international graduates with a master’s degree or a PhD from an eligible Ontario university.

Once you are notified that this application is successful and you have been nominated by Ontario, you can proceed to apply for permanent residence. 

  1. At least one year of full-time study in an eligible university in Ontario, and provided you complete a master’s degree by the end of your studies.
    In case you received a grant, scholarship or bursary which obliges you to return home at the end of your studies you will not be eligible. 
  2. Your application must be submitted within 2 years of completion of your master’s degree. 
  3. Language proficiency in French or in English at a CLB level 7 or higher. 
  4. Legally reside in Ontario for the duration of at least 1 year during the 2 years prior to your application. 
  5. Demonstrate intent to live in Ontario after your approval.
  6. Provide proof of sufficient funds to provide for yourself and any family members joining you in Canada. 
  7. You must be either outside of Canada or legally residing in Ontario at the time of your application. You are not eligible if you are residing in any other province at the time of your application. 
  8. If applying whilst legally residing in Ontario, you must ensure your legal status is valid for the duration of your process. 
  1. Complete a PhD degree and receive your PhD from an eligible Ontario university. 
  2. A minimum of 2 years of PhD studies completed in Ontario.
  3. Your application must be submitted within 2 years of completion of your master’s degree. 
  4. Legally reside in Ontario for the duration of at least 1 year during the 2 years prior to your application. 
  5. Demonstrate intent to live in Ontario after your approval.
  6. Provide proof of sufficient funds to provide for yourself and any family members joining you in Canada. 
  7. If applying whilst legally residing in Canada, you must ensure your legal status is valid for the duration of your process.

Employer Job Offer

The employer job offer category has three streams. It requires a full-time and permanent job offer from an Ontario employer to qualify. If you do not have such an offer this category is not for you.

  • Foreign Worker Stream
  • International Student Stream
  • In-Demand Skills Stream
Foreign Worker Stream

This stream targets foreign workers with a job offer in a skilled occupation at Skill Type 0 or Skill Level A or B of the National Occupational Classification (NOC). 

Once you are notified that this application is successful and you have been nominated by Ontario, you can proceed to apply for permanent residence. 

  1. A minimum of two years of paid full-time work experience in the same occupation (same NOC skill level) as the job offer. The experience must be gained within the five years prior to the application. Otherwise, you need to have a licence or other authorization for the job that you have been offered.
  2. You will need any license or authorization that is required for the position (for example: a medical license to practice medicine).
  3. Demonstrate intent to live in Ontario.
  4. If you are living in Canada at the time of your application you must have a valid visa or permit to enable your stay in Canada for the entire duration of your application process.

The job offer must be:

  1. Full-time and permanent: minimum of 30 paid weekly hours, minimum of 1560 annual hours.
  2. For a skilled occupation at Skill Type 0 or Skill Level A or B of the National Occupational Classification (NOC).
  3. The wages for the position offered must meet or exceed the median wage level for that occupation in the specific region of Ontario where you are employed. If you are working at the position prior to your application, your wage must be the same or higher than the wage you are currently earning at that position. 
    * Wage requirement does not apply in cases in which the employees have a collective agreement with the employer. 
  4. Necessary in the place of business. 
  5. The work must be done primarily in Ontario.
  6. You do not have to have any ownership in the business, however, you and your family members may own up to 10% of the business in equity. Should you and your family own a larger percentage of the business you will not be eligible. 
  1. Your employer needs to have been in active business for at least three years prior to submitting your application.
  2. They must have business premises in Ontario.
  3. They must have no outstanding orders made against them.
  4. They need to demonstrate that sufficient efforts were made to recruit a Canadian citizen or a permanent resident for the position being offered to you.
  5. If you will be working in the Greater Toronto Area your employer will need a minimum of $1,000,000 in total gross annual revenue and at least five full-time employees who are Canadian citizens or permanent residents.
  6. If you will be working outside the Greater Toronto Area your employer need a minimum of $500,000 in total gross annual revenue and at least three full-time employees who are Canadian citizens or permanent residents.
  7. An Employer Form must be signed and filed by your employer, along with supporting documents. You will require a copy of the form in your application.
International Student Stream

The International Student Stream is suitable for international students with a job offer in a skilled occupation at Skill Type 0 or Skill Levels A or B of the National Occupational Classification (NOC).

Once you are notified that this application is successful and you have been nominated by Ontario, you can proceed to apply for permanent residence. 

  1. A degree or diploma from an eligible Canadian institution for a full-time  2 year program, or a degree, diploma or certificate that requires a year to complete and requires a completed degree to be admitted. 
  2. A minimum of half your studies completed in Canada. 
  3. You will need any license or authorization that is required for the position (for example: a medical license to practice medicine).
  4. Demonstrate intent to live in Ontario.
  5. If you are living in Canada at the time of your application you must have a valid visa or permit to enable your stay in Canada for the entire duration of your application process.
  6. You must apply within 2 years of the completion of your studies. 
  1. The job offered must be Full-time and permanent: minimum of 30 paid weekly hours, minimum of 1560 annual hours. 
  2. For a skilled occupation at Skill Type 0 or Skill Levels A or B of the National Occupational Classification (NOC).
  3. The wages for the position offered must meet or exceed the low wage level for that occupation in the specific region of Ontario where you are employed. If you are working at the position prior to your application, your wage must be the same or higher than the wage you are currently earning at that position, in addition to being the same or higher than the low wage level. 
    * Wage requirement does not apply in cases in which the employees have a collective agreement with the employer. 
  4. Necessary in the place of business. 
  5. The work must be done primarily in Ontario.
  6. You do not have to have any ownership in the business, however, you and your family members may own up to 10% of the business in equity. Should you and your family own a larger percentage of the business you will not be eligible. 
  1. Your employer needs to have been in active business for at least three years prior to submitting your application.
  2. They must have business premises in Ontario.

In-Demand Skills Stream

The In-Demand Skills Stream  targets foreign workers with a job offer in specific in-demand occupations such as in agriculture or construction.

Once you are notified that this application is successful and you have been nominated by Ontario, you can proceed to apply for permanent residence. 

  1. A minimum of one year of full-time (or the equivalent in part-time) paid work experience in Ontario in the same in-demand occupation (same NOC code) as your job offer. The work experience must be gained within the three years prior to your application and performed while legally living and working in Ontario.

  2. You will need any license or authorization that is required for the position (for example: a medical license to practice medicine). You must include it in your application. 
  3. Minimum language proficiency in English or French at (CLB) level 4.
  4. A minimum Canadian high-school diploma or equivalent.
  5. Make sure to have sufficient funds to provide for yourself and any family members joining you.  
  6. Demonstrate intent to live and work in Ontario.
  7. If applying whilst residing in Canada, you must have a permit or a visa enabling you to continue residing in Canada legally for the entire duration of your process. 
  1. The job offered must be Full-time and permanent: minimum of 30 paid weekly hours, minimum of 1560 annual hours. 
  2. The position must be in one of the following occupations:
    • NOC 7441 – residential and commercial installers and servicers
    • NOC 7521 – heavy equipment operators (except crane)
    • NOC 7611 – construction trades helpers and labourers
    • NOC 8431 – general farm workers
    • NOC 8432 – nursery and greenhouse workers
    • NOC 8611 – harvesting labourers
    • NOC 9462 – industrial butchers and meat cutters, poultry preparers and related workers
  3. The wages for the position offered must meet or exceed the median wage level for that occupation in the specific region of Ontario where you are employed. If you are working at the position prior to your application, your wage must be the same or higher than the wage you are currently earning at that position, in addition to being the same or higher than the median wage level. 
    * Wage requirement does not apply in cases in which the employees have a collective agreement with the employer. 
  4. Necessary in the place of business. 
  5. The work must be done primarily in Ontario.

Business Immigration

Corporate stream

Ontario’s Corporate stream is aimed at owners of international corporation looking to expand or buy a business in Ontario.

After your business has been established and fulfilled the obligations of a performance agreement you will be able to nominate up to 5 key members of your staff for permanent residence. Once nominated, your staff members will be able to apply with IRCC for permanent residence. 

The application process has 2 stages. 

Stage 1

  • The authorized signing officer for the corporation needs to complete an application proving that the eligibility criteria are satisfied (or will be satisfied) and add all supporting corporate documents and supporting documents for each of the key staff applicants.
  • The authorized signing officer for the corporation needs to attend a face-to-face interview at the OINP office in Toronto.
  • If stage 1 of the application is approved the authorized signing officer for the corporation needs to sign a performance agreement outlining the commitments you made to invest and create jobs in Ontario.

Stage 2

  • IRCC will issue temporary work permit support letters to your key staff applicants to enable them to apply to IRCC for a temporary work permit.
  • After key staff members arrive in Ontario they will have 20 months to build the business and implement the business plan.
  • Once the performance agreement commitments are fulfilled, your key staff applicants may be eligible for nomination for permanent residence.

On the business side of the application, the business must:

  1. Be established outside of Canada for at least 36 months at the time of your application.
  2. Have an eligible structure (public corporation, sole proprietorship or partnership).
  3. Invest at least $5 million to expand into Ontario or purchase a business in the province.
    • The investment funds must be obtained legally.
    • The investment activity must be of economic benefit to Ontario.
    • The primary purpose of the investment can not be getting interest, dividends or capital gain.
  1. The business must create a minimum of 5 full-time permanent positions for Canadian citizens or permanent resident for each key staff member you nominate (so if you nominate 5 staff members you will need to create 25 positions).
  2.  The business must have a clear structural link between the parent company and the Ontario business.
  3. The business must prove intent to turn a profit through the sale of goods and/or services.
  4. The business’ primary income must be from an active income.
  5. The business will comply with all federal, provincial and municipal laws, codes and regulations.
  6. The business must operate in a permanent capacity. Seasonal businesses or temporary project based businesses are not eligible.
  7. In case of a purchase of a business in Canada, the corporation will comply with all business purchase rules and regulations.
  1. The staff member must be essential to establishing and operating the business.
  2. The staff member must be in a senior, executive, management or specialized knowledge capacity in your corporation’s existing business. Only one key staff applicant can be in the NOC skill type A position, the remaining key staff must be in the NOC skill level 0.
  3. The staff member needs to have a minimum of 3 years’ experience with your company in the intended position from the last 4 years.
  4. The staff member has been working continuously in that position in your company in the 12 months immediately prior to the application.
  5. The staff member does not have immediate family with any member of your corporation’s executive board or board of directors or shareholders holding over 10% equity in your company.
  6. The staff member does not hold now or in the past equity in your corporation, except in the case where that equity was obtained as part of their employee contract. In this case the equity must be smaller than 10% of your corporation’s business.
  7. Key staff positions in the proposed business in Ontario must be permanent and full-time jobs and meet or exceed prevailing wage levels.

Some types of business are not eligible under this stream. For your convenience, here is the list of ineligible businesses:

  • Automatic car wash operations
  • Holding companies
  • Laundromats
  • Pawnbrokers
  • Pay day loan and related businesses
  • Scrap metal recycling
  • Tire recycling
  • Businesses previously owned/operated by current or former OINP business stream nominees

If your business will be located in the Greater Toronto Area, the following types are also ineligible:

  • Existing franchises in Ontario (new foreign franchises expanding into Ontario are permitted).
  • Gas stations
  • Bed and breakfasts
Entrepreneur Stream

Ontario’s Entrepreneur Stream is aimed at entrepreneurs from outside of Canada looking to start a new business or buy a business in Ontario.

After you have been nominated you will need to apply for permanent residence with the IRCC. 

The application process has 2 stages. 

Stage 1

  • Fill out an expression of interest.
  • If invited – submit an application.
  • You and your business partner (if applicable) must attend a mandatory face-to-face interview at the OINP office in Toronto.
  • If stage 1 application is successful you will need to sign a performance agreement.

Stage 2

  • IRCC will issue a temporary work permit support letter that will enable you to apply for a temporary work permit.
  • You will have 20 months to implement your business plan and submit a final report.
  • If your business fulfills all the requirements, you will be asked  for documentation in order check your eligibility for nomination for permanent residence.
  1. A minimum of 36 months full-time experience in a senior manager or business owner capacity. 
  • Business owner capacity: ownership of at least a third of the business and an active role in the management of the business. 
  • Senior management capacity: have senior decision-making authority in the business. 
  1. Net worth:
  • If your business will be located within the Greater Toronto Area you will require a minimum net worth of $1,500,000.
  • If your business will be located outside of the Greater Toronto Area you will require a minimum net worth of $800,000.
  • If your business is in the information and communications technology/digital communications sector you will require a minimum net worth of $800,000 regardless of location.
  1. Personal investment:
  • If your business will be located outside of the Greater Toronto Area you will need to make a personal investment of $1,000,000 at least and have control of one-third of the equity in the business at the least. 
  • If your business will be located outside of the Greater Toronto Area you will need to make a personal investment of $500,000 at least and have control of one-third of the equity in the business at the least.
  • If your business is in the information and communications technology/digital communications sector you will need to make a personal investment of $500,000 at least and have control of one-third of the equity in the business at the least – regardless of location.
  1. You must be involved in the management of the business in an active manner on an ongoing basis.
  • Business owner capacity: ownership of at least a third of the business and an active role in the management of the business. 
  • Senior management capacity: have senior decision-making authority in the business. 
  1. The primary purpose of investing in the business has to be the gaining of profits.
  2. You will be required to create at least 2 permanent full-time positions for Canadian citizens or permanent residents. This must be completed within 20 months of establishing the business. These employees must be paid a salary that is equal to or higher than the median wage level for the position.
  3. When purchasing a business:
  • You will need to make one or more business-related visits to Ontario within 12 months of filing your EOI.
  • The business purchased must have been operated by the previous owner for a continuous period of at least 60 months.
  • Ownership of the purchased business must be entirely transferred to you or your business partner (if applicable).
  • A portion of your personal investment must go to improving or expanding your business in Ontario
  • All permanent full-time employees that were employed in the business prior to its purchase must remain employed with the business.

 

  1. The purpose of the business must be to turn a profit selling goods and/or services. 
  2. The business will abide by all federal, provincial and municipal laws, codes and regulations. 
  3. The business must operate at a permanent capacity. Temporary projects and seasons operations are not eligible. 
  4. You must have a place of business in Ontario at all times. 

Some types of business are not eligible under this stream. For your convenience, here is the list of ineligible businesses:

  • Automatic car wash operations
  • Holding companies
  • Laundromats
  • Pawnbrokers
  • Pay day loan and related businesses
  • Scrap metal recycling
  • Tire recycling
  • Businesses previously owned/operated by current or former OINP business stream nominees

If your business will be located in the Greater Toronto Area, the following types are also ineligible:

  • Existing franchises in Ontario (new foreign franchises expanding into Ontario are permitted).
  • Gas stations
  • Bed and breakfasts
